Terms of Service

1. Agreement to Terms

By accessing or using StackEnhance ("Service"), operated by Stack Enhance AB (Org.nr: 559427-8375), a Swedish company, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

StackEnhance is an email marketing intelligence platform that helps B2C brands analyze competitor email marketing strategies. Users forward marketing emails to unique addresses, and the system provides AI-powered analysis and insights.

The Service includes email parsing, AI analysis, competitive benchmarking, and reporting features.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 16 years old to create an account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Upload malicious content, viruses, or harmful code
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Scrape, mine, or collect data from the Service without permission
• Use the Service for spam or unsolicited communications
• Impersonate any person or entity

We reserve the right to terminate accounts that violate these terms.

5. Email Content

The Service processes emails you forward to your StackEnhance inbox. By using the Service:

• You represent that you have the right to submit the email content
• You grant us a license to process, store, and analyze the content
• You understand emails are processed by AI services for analysis
• You acknowledge that email content from brands remains their intellectual property

Important: Only forward marketing emails you have legitimately received. Do not forward confidential, personal, or proprietary communications.

6. Subscriptions and Payments

Some features require a paid subscription. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions auto-renew unless canceled before the renewal date
• Prices may change with 30 days notice
• No refunds are made for the remaining period after a cancellation unless required by law (see section 7)

Payments are processed securely by Stripe. We do not store your payment card details.

7. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation:

• You will retain access until the end of your current billing period
• The cancellation takes effect at the end of the paid period; no refunds are made for the remaining period unless required by law
• Your captured data is retained. A downgrade changes what the plan can view, not what is stored — the moment you upgrade again, everything reappears exactly as it was

Account deletion is handled as described in our Privacy Policy: while your account is active, your account data, forwarded emails, analysis and brand records are retained indefinitely; on deletion we erase your personal identity after a 30-day grace period, while the de-identified community data built from forwarded marketing emails is retained.

8. Intellectual Property

The Service and its original content (excluding user-submitted content) are owned by StackEnhance and protected by intellectual property laws.

Our content: Logos, designs, text, graphics, and software are our property.

Your content: You retain ownership of emails you submit, but grant us a license to process them.

Analysis output: AI-generated insights and analysis may be used freely for your business purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy or reliability of AI-generated analysis
• Uninterrupted or error-free operation
• Security of data transmission

AI analysis is provided for informational purposes and should not be the sole basis for business decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STACKENHANCE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount paid to us in the past 12 months

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless StackEnhance and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

13. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Sweden.
